The PCC Legal Resource Center understands your concerns about privacy and your interest in knowing how your information is used and shared, so we have created this Privacy Policy to provide you with more information. This Privacy Policy describes the practices, policies, and procedures for our website located at www.pcc.edu/legal-resource-center (“Website”). This Website is operated by the PCC Legal Resource Center (“the Center,” “we” or “us”). By visiting this Website, you are accepting the practices and policies described in this Privacy Policy, and you are indicating that you agree to be bound by the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy you should not use any of the intake forms or links on this Website. We may update this Privacy Policy from time to time, so please check this Privacy Policy periodically for changes. The date this Privacy Policy was last updated is listed at the end of this document.

Information Collection and Protection

We collect only the information that we need in order to determine whether you are eligible for any of our services, and to help you access those services. We will never sell any of your information. We restrict access to personal information collected about you on the Website to our employees, those who are otherwise specified in this Privacy Policy, or others who need to know such information to provide services to you or in the course of conducting our operations. No website, application, or transmission can absolutely guarantee security, however. Thus, while we strive to protect your information and have established and maintain what we believe to be reasonable procedures to protect the confidentiality, security, and integrity of personally-identifying information obtained through the Website, we cannot absolutely ensure the security of the information you transmit to us.

The PCC Legal Resource Center works with a variety of third-party partners in order to make the Website available to you, to host and store the information we collect from you, to determine your eligibility for our services, and to provide certain functionality and features. We are not responsible for the content or practices of third parties. We will not release your information to third parties except to provide you with our services, if required to do so by law, or in order to protect the rights, privacy, property, or safety of the PCC Legal Resource Center, our partners, our employees, or other visitors to the Website.

We may provide links on this Website to a variety of our partner’s websites and third-party social media websites (Facebook, Instagram, Twitter and others) as a service to you, and in order to provide you additional information and content related to the PCC Legal Resource Center. We have no affiliation with any of these third-party websites. We cannot control, and are not responsible for the information collection, use, and disclosure practices of these third parties. We encourage you to review and understand their privacy practices and policies, if any, before providing any personally-identifying information to them. We are not responsible for the content, information, policies, or practices of any other website linked to on this Website.

Data Retention

We will retain your information for as long as needed to provide you services, or otherwise as is reasonable and customary under the circumstances. We may need to retain certain information for record keeping, and there may be residual information that will remain within our databases and other records, which will not be removed from such locations. Otherwise, we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We have a data retention and destruction plan that dictates the policies and procedures related to deletion and/or destruction of all information/data, and complies with Oregon law.

Note to Parents/Minors

This Website does not intentionally or knowingly collect, use, or disclose personally identifiable information about visitors to our Website who are less than 13 years of age. If a person under the age of 13 submits information to us through any part of the Website and the PCC Legal Resource Center becomes aware that the user submitting the information is under the age of 13, the information provided will be deleted as soon as it is discovered and not used for any purpose. If you are the parent or guardian of a child under 13 years of age and believe the child has disclosed personally-identifiable information to us, please contact us as soon as possible.

PCC Board Policy

The PCC district shall follow all applicable state and federal laws, rules and regulations that apply to student records. All personally-identifiable information contained in the college records shall be kept confidential and not released except upon prior written consent of the subject student or upon the lawful subpoena or other order of a court of competent jurisdiction. Student information may be shared among college faculty and staff on an official “need to know” basis. (Policy B 407)

Compliance with the Family Educational Rights and Privacy Act

The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education. As a part of Portland Community College, the PCC Legal Resource Center will protect all educational records gathered throughout all PCC Legal Resource Center processes.

PCC Legal Resource CenterGrievance Policy

The PCC Legal Resource Center (“the Center”) receives many requests for its services and must sometimes reject applicants for assistance due to the Center’s limited resources, as well as due to our limited practice areas. If you have a complaint about our services or our inability to assist you, please put your complaint in writing on our grievance form, which will automatically be sent to us via email when you click submit. The Center Co-Directors will investigate the matter and contact you within four (4) weeks from the date of receipt of your complaint. If your attorney was a volunteer attorney for the Center, please be sure to provide the name of the attorney that assisted you with your legal issue.

Purpose

This grievance procedure is established to assure that Center participants and prospective Center participants have an opportunity to express dissatisfaction with the legal services provided by the Center or to complain that the Center was unable to assist them, and to have those complaints reviewed by the Center Co-Directors.

Posting and Distribution of Policy
  1. A copy of this policy and the grievance form shall be provided to any person who requests one.
  2. A copy of this policy and the grievance form shall be posted on the PCC Legal Resource Center website at www.pcc.edu/legal-resoure-center.
Complaint Process
  1. Any person denied legal assistance, who has complaints about the legal assistance they were provided, or who has other concerns about the PCC Legal Resource Center shall be provided an opportunity to submit a written complaint on our grievance form pursuant to this policy. If the complaining party requires assistance putting their complaint in writing, someone from the Center will assist them.
  2. After submitting a complaint, the complaining party will be given an opportunity to discuss their concerns in person, via video conference, or by phone with one or both of the PCC Legal Resource Center Co-Directors. The meeting or discussion should take place as soon as possible, but the Center will reach out to set up this meeting no more than four (4) weeks from receipt of the complaint, unless the complaining party needs additional time.
  3. PCC Legal Resource Center Co-Directors will do the following:
    1. Allow the complaining party to present all information relevant to their complaint;
    2. Allow the staff persons involved to present all information relevant to the issues;
    3. Conduct the discussion in an informal but respectful and orderly manner;
    4. Provide the complaining party and the staff person or persons involved with written findings with respect to the complaint. These findings will be issued within five (5) business days after the discussion or meeting; and
    5. Provide referral information to the Oregon State Bar for further complaints after completion of the PCC Legal Resource Center Client Grievance Procedure.
Records of Complaints
  • Every time a complaint is considered pursuant to this policy, copies of all written documents relating to the complaint and copies of summaries of conversations or meetings shall be maintained on file at the PCC Legal Resource Center.
