The Associated Students of Portland Community College

Cascade Campus

Article I

Name

The name of this organization shall be the Associated Students of Portland Community College Cascade Campus, hereafter to be referred to as ASPCC Cascade.

Article II

Purpose

The purpose of this organization shall be to:

  • Improve the lives of students, staff, faculty and the surrounding community.

  • Establish goals and direction for ASPCC Cascade in the areas of governance and programs by empowering and promoting student interest and involvement.

  • Determine the budget request, monitor and approve expenditures for ASPCC Cascade.

Article III

Membership

Membership in ASPCC Cascade shall include all enrolled students of the Cascade Campus of Portland Community College, upon payment of tuition.

Article IV

Employees

Section I: Qualifications for Employment

  • In addition to the qualifications specified in the Constitution, an ASPCC Cascade employee must:

  • Be enrolled in at least six credits per term at Portland Community College during the duration of employment.

  • Maintain a minimum GPA of 2.5

  • Satisfactorily complete all classes each term, meaning at least a ‘C’ in classes taken for a letter grade or a “P” for classes taken for a pass/no pass.

  • Participate in all mandatory student leadership training as required by the Student Leadership Development Program.

  • Fulfill all job duties as defined by each position’s job description or as directed by the ASPCC Cascade General Council.

Section II: Hiring Process

  • Applicants for employment at ASPCC Cascade shall follow all processes as described in the ASPCC Cascade Student Leadership Procedures Manual, Section 2.2.

  • All personnel decisions made by ASPCC are recommendations that are subject to approval by the Dean of Student Development.

Article V

ASPCC Cascade General Council

Section I: Purpose

  • The purpose of the ASPCC Cascade General Council shall be to adopt and modify the polices of ASPCC Cascade and to generally control and regulate student activities, services and programs as provided for in these By-Laws.
Section II: Meetings

  • Regular meetings of the ASPCC Cascade General Council shall be held weekly, except the first and last week of each term, and be open to the general public.

  • Meetings shall be closed to the public only when an Executive Session has been called to discuss personnel or legal matters.

  • The meeting dates, time and location shall be made public.

  • Special meetings of the ASPCC Cascade General Council may be called by the Executive Council.

  • The ASPCC Cascade General Council shall be notified in writing four business days prior to the special meeting.

  • The purpose of the special meeting shall be stated in the written notification.

Section III: Members
  • Voting members of the ASPCC Cascade General Council shall be:

  • ASPCC Cascade Director of Legislative Affairs
  • ASPCC Cascade Social Programs Coordinator
  • ASPCC Cascade Club Retention Coordinator
  • ASPCC Cascade Environmental Sustainability Coordinator
  • ASPCC Cascade Recreational Programs Coordinator
  • ASPCC Cascade Communications Coordinator
  • ASPCC Cascade Project Specialist
  • ASPCC Cascade Middle College Student Ambassador
  • ASPCC Cascade Club Appointed Representatives
  • Women’s Resource Center Representative
  • Phi Theta Kappa Representative

B.  Non-voting members of the ASPCC Cascade General Council shall be:

  • ASPCC Cascade President
  • Student Leadership Coordinator
  • Professional advising and support staff

C. The Student Leadership Coordinator shall be the advisor of the ASPCC Cascade General Council.

  • Proxy voting will be allowed with written authorization from either the absent member or the ASPCC Cascade President.

Section IV: Quorum

  • Nine voting members of the ASPCC Cascade General Council shall constitute a quorum.

Section V: Decision Making Procedures

  • Decisions shall be made by consensus. Non-objection to motions, propositions or votes - whether implicit or explicit - shall constitute an affirmative vote.

  • Voting members may choose to file an objection, to be reflected in the minutes, without blocking a motion, proposition or vote.

  • Voting members may, via consensus, decide to suspend rules of consensus and adopt a new decision making process for an agreed upon duration.

  • Robert’s Rules of Order, newly revised, shall be the parliamentary authority, when a majority vote of the ASPCC Cascade General Council deems it necessary.

Article VI

Executive Council

Section I: Purpose

           

  • The Executive Council shall prepare the meeting agenda for the ASPCC Cascade General Council.

  • The Executive Council will ensure implementation of all decisions made by the ASPCC Cascade General Council.

  • The Executive Council shall have general supervision of the daily affairs of ASPCC Cascade between General Council meetings.

  • The Executive Council shall make recommendations to the ASPCC Cascade General Council.

Section II: Meetings

  • Regular meetings of the Executive Council shall be held weekly and be open to the public.
  • Meetings shall be closed to the public only when an Executive Session has been called to discuss personnel or legal matters.

  • The meeting dates, time and location shall be made available to the public and posted in the ASPCC Cascade office.

  • Special meetings can be called by the ASPCC Cascade President, with 24 hours prior written notice.

Section III: Members

  • Voting members of the Executive Council shall be:

  • ASPCC Cascade President
  • ASPCC Director of Legislative Affairs
  • ASPCC Cascade Program Board Member; who will be chosen by the hiring committee.

  • Ex-officio members shall be:

  • Student Leadership Coordinator
  • ASPCC Project Specialist

Section IV: Quorum

  • Two of the voting members of the Executive Council shall constitute a quorum.

  • Members in absentia may issue a written report prior to the meeting making suggestions or stating topical opinions.

  • Absent members shall be informed of decisions made during the Executive Council meeting within 24 hours and reserve the right to revisit any decisions at the next council meeting.

Section V: Vacancies

  • Vacancies will be filled using Article XIV, Section A, Sub-section I.
Section VI: Executive Council Veto

  • By consensus, the Executive Council may veto any decision made by the ASPCC Cascade General Council.

  • A veto must be submitted in writing to the ASPCC Cascade General Council within one week of the ASPCC Cascade General Council’s original decision.

Article VII

Program Board

Section I:  Purpose

  • The Program Board shall raise student awareness and involvement of ASPCC Cascade through social, educational, and diversity activities and events.
Section II:  Members

  • The Program Board shall consist of:

  • ASPCC Cascade Environmental Sustainability Coordinator
  • ASPCC Cascade Club Retention Coordinator
  • ASPCC Cascade Social Programs Coordinator
  • ASPCC Cascade Communications Coordinator
  • ASPCC Cascade Recreational Programs Coordinator
Section III:  Meetings

  • The Program Board shall meet at least once a week during each term.

  • These meetings shall be open to the public with the meeting dates, times and location posted in the ASPCC Cascade office.

Article VIII

Communications Committee

Section I: Purpose

  • The Communications Committee shall be responsible for all ASPCC communication to students, the college and the community.

Section II: Members

  • ASPCC Cascade Communications Coordinator
  • ASPCC Cascade Communications Specialist
  • ASPCC Cascade Multimedia Specialist

Section III: Meetings

  • The Communications Committee shall meet at least once a week during each term.

  • These meetings shall be open to the public with the meeting dates, times and location posted in the ASPCC Cascade office.

Article IX

Clubs

Section I: Purpose

  • Campus clubs are created to foster growth and development by connecting students with similar interests to the campus and the community.

Section II: Voting Privileges

  • Each club chartered by ASPCC Cascade shall have one representative vote on the ASPCC Cascade General Council.

Section III: Chartering a Club

  • All students interested in starting a club shall complete the following process:

  • Every club must be open to currently enrolled students.

  • A club shall not discriminate based on gender, ethnicity, age, or other equal opportunity categories as stated in the PCC Catalog.

  • Each club must have an advisor.  An advisor is an individual employed by Portland Community College Cascade Campus.

  • Each club must have a minimum of eight (8) charter members.

  • Each club official must maintain a 2.0 GPA and successfully complete their classes each term to remain in office.

  • Each club must submit a Club Charter Application form to the ASPCC Club Coordinator. (Club Charter Applications are available in the ASPCC office).

  • Every fiscal year each club must submit a Charter Application.

  • Each chartered club can elect or appoint a representative to attend the ASPCC Cascade General Council meetings.

  • This representative is eligible to receive up to a $100.00 tuition waiver per term.

  • This remuneration will be based on the representative’s attendance of the ASPCC Cascade General Council’s regular meetings and prorated for the number of meetings not attended by the representative or their proxy.

  • A club must be actively meeting, as determined by the Club and Programs Specialist, in order for a representative to receive remuneration. 

  • The remuneration will be disbursed at the end of each term, by the Student Leadership Coordinator.

Section IV: ASPCC Club Funding

  • Each chartered club will receive $150 seed money for the academic year.  Clubs chartered after fall term will receive a prorated amount of $50 for each term chartered excluding summer term.

  • In addition to initial start-up allocation, all chartered clubs are eligible to receive funding from ASPCC.

  • Proposals for funding must be submitted to the ASPCC Club Coordinator two business days prior to the ASPCC Cascade General Council regular meeting.

  • Clubs may receive funding to attend workshops, conferences etc.

  • Clubs may apply for a funding grant by:

  • Petition the ASPCC Cascade General Council, describing a 30 hour service project. The project must be approved, by consensus of the ASPCC Cascade General Council.

  • Approved projects may be completed by single or multiple individuals who have membership in the petitioning club.  The total hours of all participating members shall be totaled to achieve the required 30 hours.

  • Approved petitions must be completed within the academic school year (September – May) of the year in which they are approved.

  • Upon completion of the service project the club shall file the service petition for certification by the ASPCC Cascade General Council.  Upon certification by consensus of the ASPCC Cascade General Council the petitioning club shall receive up to $250.00 transferred to their club account.  

Article X

Budget

Section I: Supervision

  • The Executive Council and the Student Leadership Coordinator will compile the budget proposal for the following academic year and submit it to the ASPCC Cascade General Council for approval during spring term.

  • The ASPCC Cascade President, Office Assistant, and the Student Leadership Coordinator shall be responsible for monitoring the expenditures in a fiscally sound manner.

Section II: Authority

  • Any expenditure over $1000.00 shall be approved in a formal ASPCC Cascade General Council meeting.

  • Expenditures under $1000.00 may be made with approval of at least two ASPCC Cascade General Council voting members and the Student Leadership Coordinator.

  • Clubs are only eligible for expenditures as described by Article IX, Section IV, Sub-section B.

Article XI

ASPCC Cascade Strike Policy

           

  • ASPCC officers who miss designated office hours, scheduled events or fail to fulfill duties as described in their job description may receive a strike.

  • Strikes may be issued by ASPCC Officers, the Student Leadership Coordinator or other professional leadership staff.

  • Strikes shall be filed in triplicate; the white copy shall go to the individual receiving the strike; the pink copy shall go to the Student Leadership Coordinator; the yellow copy shall go to the Student Body President for review.

  • Upon receiving a strike, an ASPCC officer may file an appeal within five business days of receiving the strike. Appealed strikes will be reviewed by the Executive Council for possible repeal. If the offending officer is a member of the Executive Council, the remaining members shall review the strike and the possibility of repeal.

  • Any officer receiving three strikes in a single term or a total of five during an academic calendar year is subject to immediate termination.

Article XII

 Term of Office

A. The terms of officers of the ASPCC Cascade shall be one year, July 1 through June 15.

  • A member may serve a combination of three years in any ASPCC position.

 Article XIII

Dismissal or Removal from Office

  • A student who is not meeting the job requirements, due to absences from the work place, failure to adequately perform the duties of the job as stated in the position’s job description and failure to meet qualifications in Article IV of these By-Laws employment shall be referred to the Executive Council for review and possible recommendation of termination, probation or other action.

  • The procedure for managing absences, as stated in Article XI of these By-Laws, shall be used to document the need to remove an employee from office.

  • Dismissal of the ASPCC Cascade President will follow the above procedures, except that termination decisions shall be brought to the ASPCC Cascade General Council for review and possible termination recommendation, as decided by consensus.

  • Aside from the above procedures, ASPCC Cascade employees may be removed from office for just cause, as defined by the Portland Community College Classified Employees’ Contract.

  • No public statement may be made by any ASPCC Cascade employee or the Student Leadership Coordinator regarding the personnel action while the employment investigation is in progress.

  • An appeal may be made to the Cascade Dean of Student Development within five working days of the decision notification.

Article XIV

Vacancies

  •  The Executive Council shall recommend to the Student Leadership Coordinator an internal promotion, or the standard hiring practice described in Article IV, Section II, each time a vacancy needs to be filled in ASPCC Cascade.

  • If the internal promotion process is used, the candidate must be a student who is currently employed by ASPCC Cascade.

  • Nominations for promotion will be made by members of the Executive Council.

  • After accepting or declining their nomination, candidates will be given two minutes to discuss their qualifications for the position.

  • The confirmation, by consensus, of any promotion will take place at the next General Council Meeting.

  • In the event that there are two or more candidates for promotion, consensus shall be suspended and a secret ballot issued to voting members of the General Council.  The winner shall be determined by a plurality of votes cast and immediately qualify for employment.

  • If the position is not filled, during an internal promotion process, a hiring process will be used instead.

  • If a standard hiring process is used, the hiring process shall be conducted as stated in Article IV, Section II.

  • The Hiring Committee to fill a vacant position shall consist of the Executive Council or their appointees that are voting members of the ASPCC Cascade General Council.

  • If the ASPCC Cascade President position becomes vacant the Director of Legislative Affairs shall assume all the duties and responsibilities of the office. The vacant Director of Legislative Affairs position shall be filled as described in Article XIV, Section A.

  • If the Director of Legislative Affairs cannot fulfill the ASPCC Cascade President’s job duties, for any reason, a hiring process will be conducted as described in Article XIV, Section A.

Article XV

College Committees

  • With the exception of the District Student Council (DSC) and the Oregon Community College Student Association (OCCSA), The ASPCC Cascade President shall approve all appointments for any committees requesting student representation from ASPCC Cascade.

  • A committee representative may be replaced on the committee if the ASPCC Cascade General Council determines in an Executive Session that the representative is not fulfilling the duties of representing the students

  • A written notification will be presented to the representative with statements of cause and the representative can address the issues presented in an Executive Session of the ASPCC Cascade General Council.

  • Following an ASPCC Cascade General Council decision, the representative may appeal their case to the Cascade Dean of Student Development within five working days from the receipt of written notification of the decision.

  • District Student Council (DSC) candidates for the following year shall be nominated by the Executive Council of ASPCC Cascade. The Executive Council shall nominate three candidates for the following academic school year. Candidates shall be confirmed by consensus vote at the last meeting of the spring term of the ASPCC Cascade General Council.

  • If a candidate is not confirmed by the ASPCC Cascade General Council, the Executive Council may appoint a temporary council member to be confirmed at the first October meeting of ASPCC Cascade’s General Council.

  • District Student Council (DSC) representatives may be removed from the District Student Council.  In such cases, consensus shall be suspended for a vote of no confidence in the DSC representative.  A two-thirds “yes” vote from voting members of the ASPCC Cascade General Council will result in the removal of said representative from the DSC.

  • Vacancies in DSC membership shall be filled as described by Article XIV, Section A.

Article XVI

Amendments

These By-Laws may be amended at any regular ASPCC Cascade General Council meeting by consensus, provided that the amendment has been submitted in writing at the previous regular meeting.
